Update on my friend's year 6/1 FM3 - colleen - 07-05-2012

So...he got a letter from his US bank FedExed to him w/ lots of important looking stamps on it. He had a friend translate it. He got another letter from his MX bank. He took info about his home ownership and all the other usual copies and went to Leon yesterday, the 4th, after the year 5 FM3 expired on July 2. They took him into a back room and interviewed him, making notes on his answers about why he wanted to live in MX and why he wasn't asking for an FM2. (He's got to be in CA for the school year). He said it was lucky that he had his home ownership info.

They sent him to the bank to pay about 1400 pesos for the new FM3 (or whatever it is now called). He brought the receipt back and was told to come back in 5 days to see if the office in D.F. would approve his application. When he returns at that time, he will be told how much his fine will be for being in the country w/o a visa, tho they wouldn't let him apply while the visa was in effect. He'll go pay the multa and then they say it will be about 3 more days.

So it's a minimum of 3 visits to the office. Interesting that they are pushing the FM2, or appear to be. The people who I have talked to about renewing their FM3s w/ less than 5 years have had no problem. It's always interesting and now there is a new govmt so who knows what will happen next? Not me.

I was at INM?s office yesterday and they gave me the load down on the new requirements, fines, etc. I would like to offer a brief description to the foreign community about the new laws, requirements, reasons for the fines and clarify some of the changes that are still in the works. Hopefully we can accomplish this in one or two weeks.

I?d like to hear exactly what happened to him/her to see if I can be of any assistance. The folks in Le?n are very helpful to me in dealing with every individual situation.

I have commited to translate ALL the "formatos" into English in order to facilitate better communication among those who are having difficulties in getting the appropriate documentation together BEFORE filing and/or paying the wrong fees or fines. Stay tuned!

I am interested in what you find/found out. It seems like we are still waiting (another week?) to find out what the procedure is for getting my visa started? I called your office today and left a message with Mario. Looking forward to hearing from you. Thanks.

For those of you who don't know me, I am a recent arrival, seeking permanent residence. Since the laws have changed (are they changing daily?), Martha has been helpful, though it seems her hands are tied, in a way, when she cannot get clarification. Here's hoping for the best for all of us.


RE: NEW REQUIREMENTS FROM INM - meroberts - 07-07-2012

In order to process or renew your Non-Immigrado or Immigrado documentation, you no longer need to download the previous three months of bank statements.

These are the new requirements:

1) If you are retired, you need to present original and copy from your Pension Fund and/or Social Security Administration indicating that your annual income is approximately $24,932 pesos per month (400 times the minimum Mexican salary which is currently $62.33 pesos per day), and 50% per additional family member.

2) If you own property, you are only required to earn $15,582.50 pesos per month (250 times the minimum Mexican salary which is currently $62.33 pesos per day), and 50% per additional family member.

3) If you are NOT retired, you need an original letter and copy from a bank in your country that will state that you receive sufficient funds from a source in your country equal to the same amounts stated in points 1 and 2 above.

There are other changes to be implemented but have not been approved yet. I will notify you as they begin implementation of any new laws and requirements.

The INM office in Le?n will provide me with a set of forms with the new and different requirements. I will translate them into English for you guys. I hope this will be helpful.

Owning property is that in the U.S or Mexico


Property ownership for Visa de Imigrado Rentista - meroberts - 07-08-2012

In order to reduce the income necessary to live in Mexico with an Imigrado Rentista status, you are required to own property in Mexico.

As well, you still have to prove and guarantee that you will receive the approximate amount of $25,000 pesos per month from overseas to live here in order to obtain the Imigrado Rentista status either with your Pension confirmation or home ownership.

Martha I do appreciate your help! Does it make any difference if your wife is a Mexican citizen? Also just a thought if one had 2 banks they could just electronically transfer $2500 back and forth each month and this would show as deposits.

In order to better respond to you on how to deal with your particular situation and personal circumstances, I would prefer that (if you wish) you set up an appointment with my office in San Javier (109 2263), as there are several ways to handle it. However, I charge $495 p. per 1/2 hour.

Let me just warn you that what you suggested as a possible alternative of using two banks and making deposits back and forth will no longer work and is no longer allowed.

If what I learned by calling 415 152 8991 (INM, San Miguel) is correct, the process may be easier in SMA. The person I talked with said either a letter from the bank or from the pension fund will be accepted. But it will be great to hear from someone who goes there. Incidentally, the income requirement is less for FM3 than FM2.

OK Folks,

So much and different information is being written on this forum by us, that it has become confusing even to those of us who often call and/or frequent both offices and, admittedly, even those of us who do this for a living. I have been guilty of receiving misinformation too.

But this is what I know to be the latest?

All applications go from the office in Le?n to SMA on daily basis for evaluation and approval. SMA is the main delegation, while Le?n (is a sub-delegation) but closer and more convenient for some.

Please note that the terms FM3 and FM2 no longer exist, should no longer be used, and continue to cause confusion among new-comers.

The requirements or conditions for the new procedures and the cost of these processes have also changed, depending on the type of visa you'd like to apply for.

For Immigrant or Non-Immigrant, the required yearly income (about 25,000 pesos per month) must be now certified by your bank, Pension Fund Organization, and/or the Social Security Administration. If you own property in Mexico it is reduced to 50%. You may now also be required to pay for the Registro Nacional de Extranjeros (RNE - currently $750 pesos) as part of your application, etc.

In order to better assist you, I have attached below, the most common forms currently used. They include the new and different definitions, costs, and conditions by which you can now obtain you visas. You may also visit the INM website by clicking on this link.
